Rules & Conditions of Participation
Could you represent Australia at the World's biggest teenage modeling competition?
The following expressions have the following meanings:
"Agreement" means the contents of the Entry Form, these rules and conditions of participation and the schedules.
"Contest" means the Miss Teen Australia contest being held in the contest year
"Contest Period" means the period from the time of your official arrival in the location of the contest venue to the time of your official departure from that location.
"Contest Venue" means the venue or venues designated by us for the holding of the contest in the contest year and include any changed venue or venues.
"Contest Year" means the year designated on the Entry Form.
"Entry Form" means the first and second page of this agreement, which comprises your application to participate and our acceptance of you as a contestant.
"Miss Teen Australia" means the organisers, its officials and assigns.
"Miss Teen Australia winner" means the girl selected as Miss Teen Australia at the contest in accordance with the rules of the contest.
"Miss Teen Contest" means the contest to select the Miss Teen in the contest year
"Option Year" means the year following the year of office during which we may, subject to the right of Miss Teen Australia or a runner-up to retire to private life, request her to continue to represent us in respect of the Miss Teen Australia title.
"Runner-up" means a contestant who is selected in second or third place in the contest.
"Year of Office" means the period from the date of selection of the Miss Teen Australia until the date of selection of Miss Teen Australia at the contest the following year.
PART I Eligibility
1. You warrant that you fully comply with the eligibility criteria set out in Schedule A
2. You undertake to remain eligible throughout the contest period and, if you are selected as Miss Teen Australia or as a Runner-up, for the year of office and the option year.
PART II Rules and Conditions of Your Participation in the Miss Teen Australia Contest
1. You acknowledge and agree that:
2.1 the contestant participate in the contest as a volunteer for no fee and that there is no employer/employee, agency, joint venture or partnership relationship between us
2.2 all copyright in all recording media used in respect of the contest in which you appear, including without limitation photographs and other recordings of your likeness, name
2.3 and voice, belongs to Miss Teen Australia absolutely and you assign any copyright you may have to us to give effect to this ownership; and
2.4 Miss Teen Australia may use your likeness, name and voice for no fee to promote the contest at any time in programs, in any media, in advertisements, promotions and publicity and for any other purpose (except for any purpose which is inconsistent
with the image of Miss Teen Australia)
3. A non-refundable registration fee of $125.00 incl. GST must be paid with your application.
PART III Our Undertakings
1. Miss Teen Australia will:
1.1 use all reasonable endeavours to promote and conduct the contest;
1.2 meet you on arrival at the commencement of the contest period;
1.3 provide you with suitable accommodation and 3 meals per day during the contest period;
1.4 provide a chaperone for you during the contest;
1.5 provide you with transport on location, equally with all other contestants, to enable you to fulfill our itinerary for contestants during the contest period including rehearsal appearances and the contest final;
1.6 generally direct, advise and counsel you as to your conduct and well-being during the contest period and supervise your activities and assist you in the contest throughout the contest period equally with all other contestants; and
1.7 transport you to your place of departure for your return to your place of embarkation at the conclusion of the contest period or your participation in the contest, whichever is the earlier.
PART IV
Judging of Miss Teen Australia Contest
You acknowledge the rules for the judging of the contest set out in schedule C and agree to be bound by them and the decisions made under them.
PART V your obligations if you are selected as Miss Teen Australia or as a Runner-up
If selected as Miss Teen Australia for the contest year or as Runner-up, you will carry out your obligations as set out in schedule D.
PART VI Special Provision
1. We reserve the unfettered right and discretion at all times, in the best interests of the contest or the reputation of the Miss Teen Australia title (as to which we are the sole judge) to:
1.1 withdraw you from the contest at any stage on the grounds that you have committed a breach of any undertaking or warranty given on your part in this agreement or have committed an illegal or immoral act or have acted in a manner which is harmful to the image of the contest or which could in our view and at our sole discretion, bring you and/or the contest and/or Miss Teen Australia title and Miss Teen Australia into disrepute;
1.2 cancel, postpone or bring forward any provisional date for the contest or change the contest venue or change the manner in which the contest has traditionally been held due to reasons beyond our reasonable control;
1.3 in the case of any dispute, withhold any award of the title or prize until any dispute is settled at which time, in our absolute discretion, we may award such title and/or prize to any other Runner-up or any other contestant in the event of any dispute following the election of Miss Teen Australia;
2. We will not be liable under any circumstances for any loss or damage sustained by you as a result of or arising out of the exercise by us of any right or discretion or in respect of any act or decision made by us under this agreement that we decide (in our sole discretion) to be conducive to the successful running of the contest and we will not be liable to you for:
2.1 your non-arrival or delayed arrival on the proposed date or changed date of the contest;
2.2 illness, injury or other incapacity sustained by you up to and during the contest period; or
2.3 Loss of or damage to any of your possessions during the contest period.
3. If you are selected as Miss Teen Australia or as a Runner-up and during the year of office either:
3.1 commit a breach of this agreement or fail to carry out any of your contractual obligations (including the obligations set out in schedule D); or
3.2 commit an illegal or immoral act or conduct yourself in a manner which in our opinion is harmful to the image of the contest or which in our opinion brings or tends to bring you or the Miss Teen Australia, title or the contest into disrepute, ridicule or contempt,
Miss Teen Australia may declare your title as Miss Teen Australia or Runner-up (as the case may be) forfeits and upon such declaration you must immediately cease to use such title for all purposes whatsoever. Such forfeiture is without prejudice to any other rights that Miss teen Australia may have.
4. This document is governed by and is to be construed in accordance with the federal laws of Australia and each party submits to the non-exclusive jurisdiction of its courts.
SCHEDULE Eligibility for entering the Miss Teen Australia Contest
You must:

You must:
a) not, without our prior written approval, participate in any other beauty contest (excluding the Miss Teen Australia) during the period commencing 60 days before and ending 60 days after the contest;
b) arrive at the location of the contest venue by the date and time and at the place notified to you by Miss Teen Australia, but if you arrive earlier or stay later than the day following the contest you acknowledge that we will not be responsible for your security or upkeep for those periods;
c) ensure that you have sufficient funds to pay for any excess baggage payments both on your outward and return journeys;
d) have in your possession on arrival for the contest clothes adequate and suitable for travelling and for day-to-day wear at the contest venue for the contest period but we reserve the right in our absolute discretion to require you to wear the clothes provided by us for judging purposes;
e) conduct yourself appropriately and not commit any act of an illegal or immoral nature, any act which would bring discredit on yourself or be harmful to the image of the contest or any act
Which would bring the contest, Miss Teen Australia and/or its title into disrepute throughout the contest period?
f) comply willingly at all times during the contest period with our directions advice and counsel as to your conduct and well-being;
g) participate in all rehearsals during the contest period
h) stay with the official party of contestants at all time during the contest period and not otherwise leave the accommodation which has been provided for you;
i) not accept private engagements during the contest period;
j) permit Miss Teen Australia to take and/or use photographs and other material concerning you for the purposes of the contest and related publicity;
k) if requested, appear on any print, visual and audio media, television, advertising, internet or other coverage of the contest and related publicity;
l) not at any time commercially exploit or aid the commercial exploitation of your title in any way whatsoever except exclusively through, and with sole agreement of Miss Teen Australia or as Runner-up;
SCHEDULE C Judging of the Miss Teen Australia Contest
a) The judges will pay equal attention to each contestant's aptitude for making the most of her abilities, and her attitude towards developing them. Although the judges will give equal importance in their markings to physical and other personal attributes and talent, it must be emphasized that these are not intelligence tests. The judges will be trying to assess each contestant's determination to use whatever ability she may have to further either her own career, or help others to do so.
b) You will be judged in personal interviews, the ability to answer a random question, a full-length evening dress, casual wear and in swimwear, which shall not carry any form of advertising, or emblem, which has not been approved in writing by us. You may not wear any other form of clothing unless agreed or requested by Miss Teen Australia who has absolute discretion in banning any clothing or beachwear considered being unsuitable for the Miss Teen Australia image. We reserve the right to substitute other leisurewear for beachwear, and other apparel for evening dress. We also reserve the right to require you to wear clothing provided by Miss Teen Australia.
c) The Miss Teen Australia winner should be an example to all young people, both in conduct, determination, integrity and honesty.
d) Miss Teen Australia alone will decide the composition of a panel of judges and the form that the judging will take. In particular we reserve the right to introduce public opinion judging over the Internet or the telephone.
SCHEDULE D Terms and Conditions if you are selected as Miss Teen Australia or as a Runner-up
You acknowledge and agree that:
a) all copyright in all recording media used during the year of office in respect of your post-Contest duties in which you appear, including without limitation photographs and other recordings of your likeness, name and voice, belongs to Miss Teen Australia absolutely and the contestant assign any copyright you may have to Miss Teen Australia to give effect to this ownership;
b) Miss Teen Australia may use your likeness, name and voice to promote the contest and the Miss Teen Australia title. At any time in any media, in advertisements and publicity and for any other purpose (except for any purpose, which is inconsistent with the image of the contest or the Miss Teen Australia title).
c) You must continue to adhere to the rules of eligibility set out in Schedule A throughout the year of office and the option year.
d) You must conduct yourself with decorum during the year of office and the option year and must not commit any act of an immoral illegal or other similar nature. Which in our opinion would or would tend to bring the contestant, the contest, the Miss Teen Australia and / or title into disrepute, or content or which would be harmful to the image of the contest.
If you are selected as Miss Teen Australia you will be required to:
e) carry out engagements, personal appearances, advertising, sponsorship endorsements in Australia upon such occasions during the year of office and the option year;
f) if requested by Miss Teen Australia, attend the Miss Teen Australia Contest for the year following the contest year (including rehearsals and ceremonies if so requested) and will crown the Miss Teen Australia for that year;
g) not make any public appearances except as Miss Teen Australia nor endorse any product or allow your name, likeness, voice to be used in connection with the advertising or sale of any product or service without our prior written permission during the year of office and the option year.
If you are selected as a Runner-up:
h) You may be called upon to replace Miss Teen Australia if she is unable to fulfill her duties under this agreement; and
i) If you are called upon, the conditions are applicable in paragraph (e) above apply;
If during the year of office as Miss Teen Australia or as Runner-up:
J) refuse to carry out your duties
(i) become so mentally, physically or otherwise incapacitated that you are unable in our reasonable opinion, to carry out your duties;
(ii) marry, or
(iii) are in breach of any other restriction, undertaking, warranty or condition of this agreement; or
(iv) are prevented from carrying out your duties including because of causes beyond your reasonable control, we may terminate this agreement by giving one weeks notice to that effect. And neither party shall have any further obligation to the other except in relation to any rights, which have accrued prior to the date of termination.
(v) Miss Teen Australia will not be liable for any loss, injury or damage sustained by you as a result of or arising out of the conduct of your duties during the year of office or the option year except in the case of our negligence.
